[3026504.ged] The will of Elisha Berry is mostly not readable because of a fire in 1870. If Richard was mentioned, his name cannot be shown. However, the land records of North Kingstown to prove that Richard was the son of Elisha. One of the sources I've found for this family gave his middle name as Elisha, I believe this was an attempt to reconcile the will, which was abstracted by Beaman, with the fact of Richard in Westerly. I find it doubtful that they would have given Richard the middle name of Elisha, and then named a son Elisha, I have never seen in a record show in Richard with the middle name of Elisha. Note that birth records of East Greenwich give his birth. Note that Richard is referred to as deceased in the deed from Seth White Jr. to James White dated February 4, 1785. 4 The town council voted that Richard Berry was to have three pounds for going to Newport on town business. (Vol. 5 page 37) Richard Berry of Westerly, cordwainer, sold 12 acres of land in North Kingstown, Rhode Island on that date. These books are burned and it is hard to make all it all the details, but I think he sold the land to Solomon Carpenter of South Kingstown. I can' t read the price. I think this land was in two tracts, one four acres which was bounded by Samuel Fones Jr., Mr. Havens, and Richard and Elisha Berry. The other tract was eight acres, bounded by Nathaniel Havens, and Charles and Richard Berry, the north boundary was the four acres Richard Berry bought of his uncle, Charles Berry. Susannah, the wife of Richard Berry, agrees to this sale. It was recorded 9 March 1730/1731. Witnesses were Joseph Crandall, Elkanah Babcock and Seth White Jr. The book is very faded and I couldn't get a good photo copy. I extracted the following provisions from the will: To my wife, Susannah Berry, during her natural life or Widowhood, the use and improvement of my homestead and personal movable estate, except what I hereafter give away. Executor to have care and oversight. Wife shall not take any family into the house to live with her without consent of executor. Executor is to get wood for widow from my lot in Cedar Swamp and cart to door fit to lay on the fire. My two sons Samuel and Peleg Berry are to have my farm, to be equally divided between them. Samuel to have the Westerly part with house. Peleg the southerly part, Peleg not to lay account against the estate or he gets nothing. I give my son Elijah Berry one acre of land in Cedar Swamp, next to great Fresh? Pond. Samuel and Peleg to divide rest of land in Cedar swamp. I give to my beloved granddaughter, Susannah Johnson, my loom and tackling.. I give to my granddaughter, Susannah Berry, daughter of my son Samuel, one feather bed called Susan's bed, forever. To my three sons, Elijah, Samuel and Peleg all my farming carpentering tools to be equally divided. My six sons are to divide my wearing apparel: Elisha, Elijah, John, Simon, Samuel, and Peleg. My eight children: Elizabeth Johnson, Elisha Berry, Elijah Berry, Sarah Gorton, John Berry, Simon Berry, Samuel Berry, and Peleg Berry, are to divide the rest of my personal estate after the death of my wife. To my four sons, Elisha, Elijah, John and Simon, 50 Spanish silver dollars to be paid by my executors after the death of my wife. Samuel and Peleg Berry are appointed executors. The will was proven by Joseph Crandall and Elkanah Babcock and entered for record in March 1785. This will is shown on page 536 in Volume 6 of town council and probate records, LDS film number 930806. The inventory of the estate appears on page 537. At that time, Samuel and Peleg are granted letters to administer the estate.
